The Registration Act, 1908, the Transfer of Property Act, 1882 and the Real Estate (Regulation and Development) Act, 2016 mandates the registration of an agreement for sale of an immovable property. By registering the agreement for sale of an immovable property, it becomes a permanent public record. Further, a person is considered as the legal owner of an immovable property only after he gets such property registered in his name.
It is area which is the floor net usable area of any apartment\flat\portion. It excludes the external walls, areas under services, shafts, balcony. However, it includes the area covered by the internal partition walls of the apartment.
- Residential houses constructed on a land area less than 5 Marla other than locality of category “A”
- The Property not capable of commanding annual rent exceeding PKR. 4320/-
- A single house not commanding annual rent exceeding PKR. 6480/- if occupied by the owner for his residence
- The buildings owned by widows, minor orphan and/or disabled person tax liability of which is up to PKR.12150/- per annum are exempted
- One residential house up to one Kanal owned and occupied by a Federal or Provincial Retired Government servant is exempted
- Those buildings owned by Government or a Local Authority such as a Corporation, Municipality or town committee
- Mosques and other religious buildings
- Buildings and Lands used as public parks and playgrounds, schools, boarding, houses, hostels, libraries, and hospitals
- Properties the rents of which are devoted exclusively to religious or prescribed public charitable institutions
Yes, 5% of the value of the property: provided that if the gift deed is executed between spouses, father, mother, son, daughter, grandparent, sibling or from one wife or widow to another wife or widow of the same husband, the rate of stamp duty shall be three percent of the value of the property
